I need opinions on how I shoud proceed if a lawsuit against Equifax will survive. I said nine reports over the last year in which Equifax that tag didn't report was not reporting on my credit report, if they really were in a car loan including last April when she reported full amount paid, now they claim to have persistent reports from as charged, a mortgage that they deleted, and then he says, claim a different account number, they have reported all the time, the collections, judgments and bankruptcy are all the writing they have stated that they didn't exist or was not reported.
I Equifax sent all the reports, which show that the product they are not prepared, and what you want to know that they are destroyed or removed from the report numbers, or the reports said. In second, they have the technology reports on the Internet dispute, be amended to say, if I have a report number from April 2009 to the reporting of the news coverage with the series of reports from April 2009, but tag in October 2009. Unless the credits, but their coverage Do I need a lawsuit. To date they have never responded to the Better Business Bureau's request, or my direct communication about their statements, they just asked for a review without.

Reply: [The bottom line is if you have proof of your claim, and it is a valid claim, there is no reason why an attorney would not take the case, or that it would go on for years and years. If it's not valid, they will get it dismissed rather quickly. If it is valid, and you have your proof, there isn't much they could argue against.
I'm not say it would be a walk in the park.. hardly. But it is far, far from going up against, say Microsoft for some type of patent issue.
You would be surprised how long litigation can be dragged out in federal civil. An acquaintance is presently in round three for the same client in federal court in a matter involving the State of Texas. Keep in mind that the Judge has already made comments suggestive of the fact that the State really ought to settle…the only real remaining question is damages. The AG has been held in contempt on two occasions and cautioned on other occasions. Yet…they are STILL in trial for the third round (two previous mistrials have been granted).
A position being valid with proof is NOT something that automatically leads to prompt resolution just because you file suit…and most pro se litigants are ill-prepared for the rigors of federal court. Further, because cases against a CRA can become extremely protracted, it is not reasonable to expect that every civil attorney will be willing to work on contingency. Besides…if the case is allegedly such a slam dunk, the Plaintiff should have ZERO objection to paying fees up front…
You nailed it.

Reply:Have you ever been involved in litigation against the big 3 other than following them on PACER? I have and it's never ever as cut and dried as you suggest. I've seen slam dunks get dismissed and weak cases settle big. It's not predictable. What IS predictable is exactly what I said, which ISN'T that it WILL take years and years. Re-read…I said "If you don't then be ready to spend years, yes years, paying an attorney."

Reply: Before you go suing Equifax you better have your ducks in a row…
1. You should find an attorney who will take the case on contingency. If you don't then be ready to spend years, yes years, paying an attorney. Equifax is a public company with more money than you can imagine. What they spend on lawyers will be largely covered by their insurance policy. The rest will be a rounding error to them. They can bleed you dry.
That is a pretty bold statement. I have read case after case on Pacer against the CRAs, and most of them do not take years and years.
The bottom line is if you have proof of your claim, and it is a valid claim, there is no reason why an attorney would not take the case, or that it would go on for years and years. You better have a darn good expert witness and not one of the hacks who do 100% plaintiff's work. I can help you find a good one if you like. They better know FICO scoring like the back of their hands and most of them don't. If you claim emotional or medical harm you'll have to hire a completely different expert witness for that because the credit experts will get disqualified from testifying about that, and they should.
3. You better have been injured and you better be able to prove it. Adverse action letters are a must. Sit down and honestly determine if you've suffered financial losses because of their actions. If you haven't then you're wasting your time.
4. You better have a ton of credit reports already in hand because getting them from Equifax is going to be like pulling teeth.

Reply: I need opinions of how i shoud proceed, whether a lawsuit against equifax will survive.
considering this will be in federal court, what does your attorney think?

Reply:The bureaus only report what the furnisher has given them. They did not just decide to wake up one morning and see if they could screw with your report. What sort of paper trail have you created with the furnisher?

Reply:In other considerations, Transunion reports a ford motor account, i sent them the report when they reported that item as paid in full, now they report this item as charged off, so i sent them a paid in full letter from ford, a copy of overpayment check for paid in full account, and a copy of the title to the vehicle, and they still will not respond or answer concerning the changing of status. In respect to the mortgage account, they deleted the current mortgage account, and then reported the same account with a different account number as if they were reporting it for the past nine months.
In respect to Experian, they with the same issue with the ford account, provided document to verify my statement, they refused to investigate, and after providing a copy of my birth certificate, and social security number, and light bill concerning the additional name listed on my account, they refused to remove the name.

Best Answer: Verizon will show the charge of for the full seven year period as that is factual. Look under the collection items and make sure the collection company has reported paid collection or a zero balance as owed. If not then dispute that to the credit reporting companies. as to your last question not all companies report to all three reporting agencies as there is a cost to do so monthly and they may just subscribe to 1 of the three. So you cannot get that part fixed

Reply:
From the FCRA:
§ 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i]
(6) Notice of Results of Reinvestigation
(A) In general. A consumer reporting agency shall provide written notice to a
consumer of the results of a reinvestigation under this subsection not later
than 5 business days after the completion of the reinvestigation, by mail or,
if authorized by the consumer for that purpose, by other means available to
the agency.
(B) Contents. As part of, or in addition to, the notice under subparagraph (A), a consumer reporting agency shall provide to a consumer in writing before
the expiration of the 5-day period referred to in subparagraph (A)
(i) a statement that the reinvestigation is completed;
(ii) a consumer report that is based upon the consumer's file as that file
is revised as a result of the reinvestigation;
(iii) a notice that, if requested by the consumer, a description of the
procedure used to determine the accuracy and completeness of the information shall be provided to the consumer by the agency, including the business name and address of any furnisher of information contacted in connection with such information and the telephone number of such furnisher, if reasonably available;
(iv) a notice that the consumer has the right to add a statement to the
consumer's file disputing the accuracy or completeness of the information; and
(v) a notice that the consumer has the right to request under subsection
(d) that the consumer reporting agency furnish notifications under
that subsection.
(7) Description of reinvestigation procedure. A consumer reporting agency shall provide to a consumer a description referred to in paragraph (6)(B)(iii) by not later than 15 days after receiving a request from the consumer for that description.
Did you specifically ask for the procedures they used to verify a specific dispute?

Reply:Yes I did, this is what I wrote:
and:

Reply:Well then… you can send them the request again along with a bill for the $1,000 they owe you for willful noncompliance.
Please let us know how it works out for you.

Best Answer: You can reply to the letter you received. There will be information on that letter on how to receive a copy of your credit report.

Also, you are entitled to a free credit report once every year for each of the 3 reporting agencies. You can spread each of the three out during a year. What I do is pull one every 4 months & check to see how things are doing. This is your right by law to get a free copy once a year.

You can do this online & print it out at the convenience of you home. & for less than $10 you can even order your credit score.

Reply:
*grin* That's what my wife says too strangely enough

Back in 2000, I moved from apt X and supposedly never paid my utilities!
Ok so, fast forward to 2005 and I checked my CR for the first time 2 months ago and had a bill for $918.00 from the utility company on exp and another bill with the same amount on transunion put in by genesis financial solutions. I researched this on my own for 2-3weeks and wrote 3 letters to exp, equifax and trans asking them to research and delete if unvalidated!
on 11-16-2005, I decided to contact the utility firm to get a bill and they said they didn't have any information/bills on me and everything was sold to genesis financial solutions. I called genesis financial and was informed they gave my information to their affliate firm in the eastcoast to handle. I called the affiliate firm, and they told me I owed $918.00 and they sent numerous mails to my old address (note I've moved twice since 2000). I asked why they notified the CRA about my 'deliquent' bill w/o any contact with me and they said by law they are required to..
Ok so I am trying to build my credit for a home purchase, I didnt wanna deal with running back and forth so I settled with them and instantly paid $600.00 to settle the debt(I think this was a stupid thing to do, and so does my wife who is an attorney to-be). I asked them when they would adjust my credit report and the rep was dancing around the question.
What can I legally do to ensure the payoff is recorded? I am also disputing the bill and figure if it comes back and isn't mine I'll get refunded.. I told them I wanted the CO removed from my acct because I didnt have a clue the account existed and I was told they would contact genesis about my payment and send me a letter of clearance. Is that enough to remove the CO? I would think I'd need THEM to report it directly to the CRA?
I don't see how a letter from plazaassociates (eastcoast firm) will alter reports genesis financial and my utilities company sent to me..
sorry this is soo long but y'all have been great! I joined 4days ago and have learned soo much already. i wish I found this site 5years ago! I'd have an AMEX blackcard and 800+ FICO

Best Answer: You go talk to some actual mortgage lenders in person with all of your financial info and see what's possible. The internet isn't going to provide the answer.

Reply:I HIGHLY suggest reading the Newbie section regarding Collection agencies and Junk debt buyers.

Reply:
I don't owe CAs but they are acting on behalf of the utilities company?? Paying them pays off the utilities? No? Please be clear! I can still put a stop to the check!

Reply:If you owe electric …FINE
YOU DONT OWE SCUMBAG CA'S
Let them suck on the bottom of the pond some more not on your wallet!!!!!!
JMHO

Reply:
CA?? Collections Agency?? Yeah I called them.. lol! Shouldnt I have? I don't wanna run circles, If I owed someone at some point, the logical thing to do is pay.. I do ok

Reply:Another thing I like about this site is no matter what you do (bad credit decisions, ask stupid question, etc) noone calls you stupid or silly, everyones helpful and thats the way its supposed to me my whole family will be joining soooon

Reply:Thats great!!! Congrats

Reply:
If you could let me know how you did it from step A thru Z, it would be appreciated. ubobase@excite.com
guypuss.. thanks….

Reply:
If you could let me know how you did it from step A thru Z, it would be appreciated. ubobase@excite.com
guypuss.. thanks….
I also would like to know because I am going through the same too!!!!

Reply:Bingo! I would like to know as well, I have the same problem, and about to file complaints with BBB, FTC and the AG.

Reply:if the bank is N.A. you need to complain to the OCC.

Reply:First I disputed with Experian and Transunion. Transunion deleted. Experian came back remains.
Disputed again as account was being reported inaccurately. They also reaged it now showing the charged off date of the account as 09/2005. (BINGO) Also showing that the account was never reported since 9/2005. I have the credit report that had the correct data prior to filing Bankruptcy.
Experian second dispute came back updated and verified. I know that this was a big Violation. Now I have been reading that we shouldnt call. Anyway I called First National Bank. They verified the 9/05 dates and then when I asked how could this be they started giving me all differnt kinds of dates and statuses in regards to closed charged off and when it was transferred.
I called every day for a week disputing, I even advised them that I had bankruptcy as they stated that they never received any paper work. I was being transferred to pay balance.
The last time I called back on 06/06 I was told that there is nothing that they can do. I will need to dispute with CRA. I advised that they are not allowing and asked me to contact the OC directly.
I then asked again what is the status of account she told me now after about 6 previous calls that I filed bankruptcy, when I asked the dates they gave me dates wish didnt match to my BK.
However each time I called I requested names, ID numbers and also wrote the time and date of calls.
I decided not to give up.
I went to the BBB website and searched for First National Credit. There was a contact there for complaints and her direct phone number.
I called the ptn and of course she was not available. However I requested her fax and then I said I am also trying to send her an email can you confirm because it keeps bouncing back. I was given the email address.
I then wrote a letter of course with the help of this wonderful board. Filed the complaint, took the same letter with the complaint # and copied it at the top of the letter emailed and faxed to contact info with all my notes that I gathered who I spoke with time information that was given listed each violation total of 6 for 6.000 dollars. I requested complete deletion or for them to update accurately and send a check for $6,000 dollars. THEY DELETED. When I checked my Credit Report on 06/09/06.
This board has been great!!!

Reply: Another victory! TU deleted and went from 699 to 761! Woohoo!
To answer the PP about my scores, I have USAA's credit monitoring service and they provide the scores to my for each credit bureau. I'm sure they are not exactly acurate, but this is the first time in my life that my credit score has been above 710 and I am absolutely thrilled about it.
To add to my excitement, I'm buying a new car and got a great APR even with the last baddie on those reports. Now all I have is 5 years left on my BK7 – lol.
I use USAA as well. Check out my signature for my true FICO and USAA FAKO scores….

Reply:I have found TU to be the easiest of the 3. Good luck.

Reply:Congrats! Where did you get those scores? Because EX doesn't sell their FICOs anymore, so I'm thinking third party reseller's "educational score"… and there's a lot more variation with FAKO scores when something like this happens, but no doubt getting your last collection off your report is a good score boost! Congrats again!

Reply: Mandy–ok yes……but if i had to choose a winner for most evil of all……..EXP.
Yes, they all are evil. But look at it this way: If it were easy to clean up your credit, and the CRA's simply responded to each dispute with a delete, then everyone would be doing just that.
Then the dispute and credit clearing process that we here use would not yield the relative results it does, and we would be on a level playing field with everyone else. As it is, with this board, we have a distinct advantage over those who fight with the CRA's with no knowledge of how they think–or leave their reports until the 7 year period ends…..
Yes, they are evil, but we are in a position to repair their carnage.

Reply:Let's all start a support group. "I've been pooped on by EX" LOL

Reply:EXP has my husbands first name. my first name. then our last name. and multiple variations of that. and they REFUSE to correct any of it. i've sent id. ss cards. etc etc. nope. so somehow, in exp world, my hubby and i are ONE Person …….not history wise, just name wise. it's an odd world that EXP land………..

Reply:I feel your pain….really I do I'd say my EX report is about 75% wrong. UGH!! We all should get together and do a march on washington……make them fix this crap.

Reply: ITA! EXPERIAN sucks! My file has 26 baddies! TWO s.s #'s! 10 addy's I have never lived at! and My maiden name, I changed it when I married….9 years ago!!!! The funny thing is…..one of the security questions they asked me to view my report…..was about a car I bought(for cash) 13 years ago….WTH?
You got me beat by 3.. I got 23 baddies (and only 3 on Equifax). . I had about 5 variations of my name, including two maiden variations. 3 socials. 4 different versions of one address.
Since your middle score counts as your FICO when you try to get credit, I'm seriously half tempted to just say the hell with EXP and concentrate 100% with cleaning up EQ and TU.
Especially since nearly EVERYTHING reported on EXP is only reported on EXP– and at least 25-30% OF IT is wrong!

Reply:EXP did delete a lot of personal info right over the p hone for me when I called them, though the one addy I REALLY wanted deleted they wouldnt and told me to contact the creditors.
I disputed 4 duplicates with them today (no doubt they're duplicates either) and 3 other accounts as "not mine" so I guess we'll see what happens.

Reply:I think they are all pure evil

Reply:exp was my worst by far. and the hardest to deal with. again, i think they are evil.

Reply:Hopefully I get 12 back on my Equifax score then

Reply: Harsh.
Man, I can clean up my EQ and TU really easy, I only have a couple of "baddies" on each.
but EXP– I got a ton of old debt on there (a lot of medical)
I also disputed a ton of EXP stuff today, including unauthorized inquiries, 3 different duplicates, and a couple of CA accounts that dont have an adress matched to verify.
how much of a negative effect does too many INQ have on your credit score? I had like 5 inquiries in about a week for satellite TV a few months ago, because at the time I didnt think about my credit score (I also disputed those today, because they were done online and I put as "unauthorized inquiries")
After 6 months they have less of an impact and after 12 months no impact on your score. Usually you lose about 3 points per inquiry made in the beginning tho.

Best Answer: You need to be a little patient with them.

From my experiences, they have always responded to the disputes. You should get a resolution letter in the mail, plus an updated copy of your credit report showing the item is now removed.

Reply:????????
No R codes on mine

Reply:R1 pays as agreed never late
R2 30 days late
R3 60 days late
R4 90 days late
R5 120 days late
R7 making regular payments under wage earner plan
R8 repossession
R9 charge off

Reply:"R code"?
Where can I find that or see if that's what is there?

Reply:the notation might not say it; but what matters is the "R" code not the words.

Reply:My hard copy report from EQ shows exactly like you stated.
Current Status – Charge Off then next to Additional Information – Paid Charge Off

I tried to get my credit report from AnnualCreditReport.com and got error message from EQ asked me to call her. Then they say they can not find me. Call back another day, my fax DL was said u0026 SS card to them. At that time she said that there is something in my report, and I could find. Fax the paperwork yesterday and was told that they find me not because I have nothing on EQ. I have more than 10 CL with 7-8 banks and they show very well on EX and TU. What's up? I must have my report on Tuesday for my first time home preparation.
How I get them to publish the report? I find it strange that neither Citi Bank, BoA, Wamu, HSBC, Chase, National City, Amex, Best Buy learned from all or EQ report.

Reply:do you have open tradelines reporting on the other three major CRAs?

Reply:Equifax let me check my file with one item on it (no inqs, no payment history, just one newly opened account) in 2006. TransUnion didn't acknowledge that I existed back then… even today, TransUnion hasn't let me check my report through them without calling to verify information.

Reply:I called them again yesterday and spoke with a supervisor. Gave her my SSN, current address, previous address, DOB, nothing matched! I told her I need the report because I'm planning to purchase a house. She told me to tell the lender to use the other 2 CRA report since I don't have anything with Equifax.
Oh and I asked her if I had multiple file and she said I don't have any file at all.

Reply:They match you up to your file based on name, address, phone, SSN, DOB, etc. Sounds like there is a disconnect between what is in your report and your actual info.

Reply:How do I know if it was split file? What do I do now? I can even sign up for myfico.com because of this

Reply:split file?
